Why we are consulting

Under section 21a of the Health and Social Care Act 2008, the Secretary of State for Health and Social Care must issue a code of practice about compliance with the requirements introduced by section 181 of the Health and Care Act 2022. The requirement is for service providers registered with the Care Quality Commission (CQC) to ensure their staff receive training on learning disability and autism appropriate to their role. The government is consulting to gather views on the draft code of practice in line with the statutory requirement to consult relevant persons about the draft code of practice under section 22 of the Health and Social Care Act 2008.

The Oliver McGowan code of practice (the code) on statutory learning disability and autism training has been drafted in line with section 21a of the Health and Social Care Act 2008, which outlines that it must make provision about:
  • the content of training
  • training appropriate to different roles
  • circumstances in which it is appropriate for training to be delivered in person
  • the involvement of people with learning disability, autistic people or their carers, in the provision of training
  • accreditation of training
  • procurement of training
  • monitoring and evaluation of the impact of training
This consultation considers the draft code and the extent to which it provides CQC registered providers with the guidance needed to meet the legislative requirement to ensure all staff receive learning disability and autism training appropriate to their role.

This is an opportunity for all interested individuals and groups to review the draft code, consider its provisions and provide their views on it.

The consultation will close at midnight on 19 September 2023.

We will analyse all submissions, and take the views expressed into account before publishing a final version of the code in due course.
